I can do better. I should be able to send you $1000.00 this week. I'm
expecting the first check from the insurance co tomorrow and provided it
clears I'll pull the cash and overnight you a $1000.00 postal money order.
The insurer promises the rest within 2-3 weeks. I can't give you the contact
info as they specify in their emails that the info contained within is
confidential and can't be shared. I will tell you its Parcel Insurance
Program.
I sincerely hope this will help you have a better Christmas. Oh - they told
me there's another check being prepared this week. The one on its way was
mailed on 12/17. It wasn't at the PO today but I'll check tomorrow and email
you immediately when I get back.
Please hang in there. We're almost home!
Regards,
David

Hi, Andy -
The check wasn't at the PO today but the postmaster said she'd look for it
and call me when it gets here. The 17th was Friday, so I'm hopeful that they
mailed it the same day they issued it. I'll email you with an update as soon
as I hear something.
Regards,
David

Andy -
We're in the middle of a major storm and road conditions are terrible. I
called the PO and their mail truck hasn't made it in yet. Its not like it is
back east when it snows! The road crews are pitiful out here. (I'm from
Boston originally). My street is a mess. I was barely able to get my wife to
her work this morning. You'd be amazed at what little snow it takes to
totally mess up the works here.

I'll be talking with the PO again in a couple hours. If its in, I'll venture
out for it.

Regards,
David

Hi, Andy -No, its not here yet. And I apologize for not emailing yesterday.
I'm down with the flu. I have been in contact with the insurer on a daily
basis. I'm going to paste exactly what they've said to me in this email:

from 12/22:
Hello - The address we sent check to was PO Box 66; Payneville, KY 40157;
Attn: Sean Tower.
If you don't receive it by December 31st, I can stop payment on it & send
out another one.

from 12/27: The following claims are scheduled to be paid Wed. 12/29/04
02010521297429876766
02010521297429871044
02010521297429852135
02010521297429871228
02010521297429824507
.
from 12/28, after I asked why the first check hadn't arrived: No, I have to
allow 10 business days for it to get to you. You may want to let your
customers know that we have 30 days to pay claims

Also from 12/28, regarding first check: mailed on 12/17/04.
10 business days will be 1/4/05

I spoke with an attorney friend by phone earlier today. He says its common
for insurance companies to use stall tactics so they can make more interest
money. I'm honestly doing the very best I can. Obviously, they may have
processed the check on 12/17, but certainly did not mail it on that date.
Please hang in there and we'll see what Tuesday's mail brings.

Regards,
David

You'll be refunded when I'm paid by the insurer, not a moment sooner.

I'm going to say this in the nicest way possible. Go to hell! I have NEVER
lied to you. Drop your complaint with paypal or there will NEVER be a
refund. I can't access funds because of you and you've cost my business
several thousand dollars in sales. Grow up a little, Andy.

Don't even bother contacting me again unless its to notify me that the
paypal complaint has been dropped. You are getting about a thousand more
than what you're entitled to, Andy. I've done the math. 3200 is the bottom
line and you will just have to wait until the insurer pays.

Andrew,

I just got back in town. Check arrived today. Check was dated 12/29 and
postmarked 01/10. It may take up to 3 business days for the check to clear.
Please send Sean a refund request for $1600.00 through Pay-Pal and I will
have it transferred as soon as it clears. I am expecting the rest of it
within a week. Thanks for hanging in there.

Regards
David

Hey, Andy -
I wound up leaving work early sick as a dog. My local postmaster says an
investigation is ongoing. 3 packages we shipped overseas were tampered with
as well. In one, the contents were smashed to bits. In another, the contents
had been removed and it arrived empty (with the postage on it for the full
weight). In the third, the contents had been removed and replaced with USPS
Global shipping boxes and newspaper. She definitely remembers your packages
going out. They lost several to a customer of ours in California that went
out in roughly the same timespan as yours. I spoke with the insurer just
before I left for work today and they tried the same garbage about the check
taking as long as Feb 10 to mail out as it was processed Jan 10. I told them
they were failing to act in good faith and mentioned the date on the first
check and the postmark. She then told me she had the check on her desk and
would mail it today. I told her I would expect it in 2 business days (St.
Louis to Kentucky). The first check was dated 12/29, postmarked 1/10 and
arrived 1/12. I'll be sure to keep you posted.
Did you get the tracking number for your refund? there should have been a
separate email confirmation. Also, once you've received your refunds, I'd
appreciate it if you would update the bad traders link and the let the Post
Office know the matter has been resolved. Andy, if either Sean or I had had
the money in hand to refund you any sooner we would have. This whole
unfortunate business has been a real education as to how insurance companies
work. Anyway, I know I got short with you at times and I apologize. I can
certainly understand your frustration. Please try to understand mine. This
warhammer stuff isn't mine. I was just helping Sean. And then somehow my
business got compromised by folks visiting the bad trader site. Anyway, I
hope we can get this whole thing resolved by the end of next week.
Have a good weekend - and if you want a little more peace of mind by having
a fax copy of those money orders, PLMK and send the fax number. I'll be more
than happy to send it!
Regards,
David

Thats all

There are quite a few more after this. Once he refunded 3200.00 he then harassed me and threatened me to remove my complaint with paypal. I finally did and he promised me a further 200.00 but then he dissapeared. At that point I just cut my losses.

Over all I got maybe 1/3 of what I paid for originally and a refund of 3200.00, so in the end I lost around 200.00 or so from the original deal, not to mention the hours I spent attempting to make contact with them. In between some of his responces weeks would go by before he made any attempt to answer. He never answered his phone either.

I also checked several times with the post office, including the post office the first packages were shipped from. They all stated that they had not heard anything from Sean or David.

Overall the entire proccess took well over 7 months. I believe the obly reason I got anything at all was due to my mail fraud complaint.

Hopefully this is enough proof that he is a bad trader.

I'd say youm did your job here.
The only recommendation I'd have made was to have you put everything in one post.
Also, in the future, I recommend keeping a copy of EVERY email (even the ones YOu send out) to substantiate of refute anything that should arise.

Lin... as far as my comment goes... check out the time. I was writing mine as yours posted. <G> Also... I didn't look up the list of bad traders to see that his was on there.

I think what this situation needs is some imagination.

MM:
No worries. :-)

ChaosOrc:
An aside question - Sean is the person you traded with; who is David? Is that the insurer person or a connected third party?

Other e-mails

Post by ChaosOrc »

I have copies of the e-mails I had sent him, but they are stored on a seperate disk that I cannot locate. I was not to worried about it, mostly because I have my responces in his replies. If you want me to post my e-mails I could do that. I think they will get rather boring when you read for the 40th time my request to know where the insurance check was.

David Hammond for some reason took over for Sean, and did all of the insurance claim stuff. Once David took over I never again heard from Sean.
To this day I have no idea who the "insurer" was. I honestly do not think there was an insurer, or postal employee involved in this entire matter. Based on everything I have found, the boxes never left Seans house.

The only reason I took the time to redo this post was because I was recently informed that he had ripped off someone else around the same time I was. They had found me by using this site, and seeing the original post. Hopefully this will help the next person before it is to late.
