send him a PM about that with explanations as why

You also have to include all of the communication history, just as if filing a BTR (good news, you can just copy & paste what's in the OP of this thread), and tell the Admin WHY you think it should be removed.

Simple answer is no. Ide rather take the ban. My only offer now is take the trade or send it all back. Relations were already washed out with poor mediation on the part of phillyt to the point where I would rather take a ban. He has still failed to prove any of this btw. Word one one trader alone is not > anothers.

No further deliberation needed one offer if not accepted then fine.

At the very least you admitted you sent the wrong model in the Cadian Vox caster Tomb King1. Also, in your very first response in our exchange following the discovery of the missing backpacks, you confirmed that not all of the Kasrkins had back packs and you knew it. As we exchanged messages, you changed your story until you finally accused me of being a back pack hoarder.

On the plus side, you have now convinced me that the policy used by most of the veteran traders is sound. NEVER send first or simultaneously to a person with a lower trade rating. I won't make that mistake again.

Tomb King1, if this your last word, then you can expect a permanent vacation from bartertown. Not only you admitted you didn't send your full part of the trade, but you also clearly refused to correct the mistakes you made in the first place. You almost deserve a place amongst our Hall of Shame...

PhillyT: i highly recommand you to fill a mail fraud report against him, you'll find all the information here:

it doesn't matter if he sent you a partial list of what was agreed, he still didn't respect your agreement.

 That is all.

A crime in which the perpetrator develops a scheme using the mails to defraud another of money or property. This crime specifically requires the intent to defraud, and is a federal offense governed by section 1341 of title 18 of the U.S. Code.

Learn the law before being the judge, jury, and executioner.

I offered a cancel of the deal twice now. It was no accepted. No fraud was committed based on that alone. However, for the kicker. It lacks both intent and substantial proof in the eyes of the law.

I have had plenty of trades online and usually I am very understanding and work with people to make things work and I wont trade with people who are generally ass hats. I have never had a case prior where I sent the wrong items or items that were not to standard agreed upon. Hell I even have 100% feedback on ebay with over 300 transactions on there. i have even traded entire armies. So why? Why is the question would I try to rob someone of 2 damn back packs? Its a matter of principal at this point. I could care less about the material cost.

I doubt you intended to "rob" me of two backpacks. I also honestly think you thought the Cadian Vox Caster was a Kasrkin. The problem I have, and where things fell apart, was when the missing back packs and the substituted Cadian were brought to your attention, you tried to flag the whole thing dead.

Your behavior and actions after the issues were brought up were no friendly or reasonable. First you admitted the back packs never existed (and it was the two special weapon models that had no back packs) and then proceeded to act like everything was fine. When I have done something similar in the past, I always make good. This entire process is based on the honor system. When given the chance to make good, you said no. You also keep forgetting that you screwed me out of the 10th Kasrkin. You can have all the great ebay references, Dakka Dakka trades, and 10 positive feedbacks on here. In this case you screwed up and have chosen to slink off.

As the person who screwed up, it is on you to make good. If you paid for the shipping on my models to you, $6.82, and the cost to ship these back to you, another $6.82, I would gladly take my flamers back. I would however require that you mail first and I will mail the Kasrkin back when I receive and verify the contents of the package. BEcause I don't trust you, nor should anyone else. Anyone reading our PM logs can see that you are dishonorable.

if you are so respectable, why don't you want fix the issue you recognized and send the 2 missing back packs?
That's a point i have difficulty to understand. As you say, Why is the question?

actutaly i learn the law and practice it for years...

First, apologies, didn't know, don't have...

My apologies I thought they all had back packs. Oh some didnt come with back packs. Sorry about that. No I have no spare back packs.

I will have to decline that offer. If you would like you can send them back and I will send you 2 more. It was unintentional and I gave you the models that were in the best shape. $6 can nearly buy you 2 on ebay. ‪http://www.ebay.com/sch/i.html?_trksid= ... &_from=R40

Plus the deal was about even considering mine are current edition models and yours are from the 90's.
then, offering something maybe....

I will take the negative and issue one in return. The original deal was for 8 oop flamers for 10 current edition kaskrin. I have met my end of the agreement you now have 10 kaskrin and I now have 8 oop flamers even if they are in pieces. I consider the deal fulfilled. Positive or negative is on you but expect the same in return. Never traded with such an uncompromising person in my life. Congrats on attaining that.
and my favorite one...

Lets get technical. Did anywhere in my negotiations with you mention that all the models had their backpacks? It was not something that was disclosed in the trade. You failed to ask. You received 10 kaskrin did you not? That is what was promised and that is what I sent. This deal is finished. Both sides have met their requirement.

Have a good day sir.

Brett
i clearly see the intend to defraud, at least a presumption of....
but thanks for the copy-paste of wikipedia, that was entertaining.

So now, either you're willing to fix the issue or not, but accept the consequences of your actions.

And you can always use a third party to do the exchange in case it is a solution that fits both of you.

You were doing good until here. Then you took a step back the wrong direction. My attitude was matching the attitude I was receiving. As listed in your negative feedback. You where uncompromising and offered an ultimatum and even tried threatening/black mailing me with a negative feedback. Your intentions might of been right but your means were crude at best. Then to top that all off I said I emailed a moderator about the situation. Something I think you might of failed to include in the original pm's. I stopped replying to your messages because you were being rude. I took the higher road. I stated that I was waiting to hear back from them and that it might be a few days per the rules that were listed on the bad trade forum. You jumped to leaving me a negative feedback and needlessly escalated it to this forum. I did have one request of you as well. I asked that you provide a picture of the models that were in question. You have yet to do so. The burden of proof is not on me. Your accusing me and for the record YOU KNOW NOTHING OF HONOR!

I have a guy who is claiming I shorted him two back packs in a trade. He wants $6 dollars(brand new models average $4.12 on GW). Me to pay for him to shim them back. I break 2 of my models and ship him those back packs. OR He is threatening a bad trader report. I have never had issues with anyone before. I am almost certain I provided 10 backpacks with the models. I believe 2 options:
1. They were somehow lost in transit.
2. He is lying

Beside all this I know how deals work being a Criminal Justice major and all.
I offered 10 kaskrin for 8 flamers. That was the premise of the deal. Not 10 kaskrin and 10 backpacks for them.

This is mute point because I sent him 10 but I am just saying even if somehow he got only 8 backpacks for the 10 models those were not mentioned in the deal or bound by the contract therein of what we agreed to trade. I am asking your guidance on this because its getting out of hand with pm's.

What I received was 7 complete kasrkin, 2 without back packs, and 1 4th edition pewter Cadian Vox Caster trooper.

You received 8 pewter flamers.

When asked to make good on the trade by sending two back packs or paying for them, you refused and accused me of trying to get free back packs off you. Even with the back packs aside, you didn't even send the 10th model. The trade was not satisfied and attempts to remedy the situation have been refused.

Certainly will, given the fact that you didn't even bother to send 10 Kasrkin. You subbed in a regular pewter Cadian for whatever reason. General incompetence perhaps?
