Backout - chocim72 Gary Hooker

Do not deal with this guy. Not a man of his word. He was selling 10mm Napoleonics painted and unpainted both priced seperately. I offered a price for all but asked for pictures first. Never received answer to my offer. After a week I got pictures and I did not like the painting or basing so I offered to buy just the unpainted figures which he accepted after several emails and I paid. Several days later I get a refund from Paypal with a note saying he found someone that wanted the whole lot and that he did not know I only wanted the unpainted. Backout, not a man of his word or words.

I will not go back and forth with this.
This website is called Bartertown, I was responding to various inquiries about my ad.
At no time did I commit to samurai (Superman) soldly,After patiently responding to his questions regarding
(the full lot) Samurai backed out of the dealings for the whole lot,Then informed me that he was taking the unpainted lot,
determining the cost of shipping from Maryland to Idaho( $6.80) .
I was then sent by samurai an email ,all without first checking to see if I accepted his offer informing me of his payment,
his price he was paying for shipping , his instructions on what to put in what size box!
Mr. Samaurai had decided for me, but that's not how it works sir.
His payment was swiftly refunded , and I respectfully delined the offer.

You are correct. This place IS called Bartertown.
It is not, however, called Backout Town.
We have a specific set of rules and procedures here.

You came to an agreement to sell him items, then changed your mind when you found a preferential deal. You never declined the offer. Declining it implies that you never accepted it. Instead, you accepted, then changed your mind.
Now, they're YOUR items and you have every right to change your mind. The fact of the matter, though, is that you DID back out of an agreement with him, which is exactly what this forum is for reporting.

So, unless you claim that he is lying and you never sent that PM, the report stands as accurate and earned.

Please, let us know if you are claiming he is being dishonest and we will move forward on that accusation.

You gave him your PayPal information and said, "I'll pack up the miniatures for shipping."
What possible reason would you have for doing that, but to have him pay you? You clearly agreed to his offer there.

Your ad stated that you wanted $30 for the unpainted. YOUR ad.
After looking at your painted stuff, he decided he only wanted the unpainted and agreed to your price (from YOUR ad).
He asked if the $36.80 would be enough, shipped, since you could fit it all into a priority box.
You agreed to the price and sent your PayPal address.
Tell me where I am mistaken on ANY of those facts, and back up your claim with facts from the PM and/or email string, please.

Therefore, it shows by the string of communication, that you agreed to a deal by replying with your paypal address. If you did not confirm the deal, then why would you tell him how to pay you and that you would pack up the minis to ship?

You state "I will not go back and forth with this.". Is there communication between you two that disproves you committed to a deal? This is what we are asking for.

If not, then this backout stands. Samurai has the right to file this backout (and technically can leave you a reference since there was a trade agreement/commitment).

If there is something we are missing that proves you are not in the wrong, then instead of posting "Barr-Humbug!!!! " (it's actually "Bah, Humbug!" if you are quoting Scrooge. Bar humbug is a popular bar in both Australia and the UK), post that instead.
