Assassin - Incomplete Trade

So this was my original advert posted in early May (can’t remember the exact date)

All figures have been stripped by their previous owner and he did a fairly good job. The previous paint scheme was standard desert camo, but very little of it is left. I got them from a previous trade, but have decided to go for straight Death Guard instead of Lost and the Damned. I’ll throw in a bag of new bases as well if you can persuade me to trade the whole lot..

3 autocannon teams
6 mortar teams
3 lascannon teams
3 heavy bolter teams (missing one of the loader figs)
10 rough riders, including sergent w/ sword (horses painted, one lance broken, still have both pieces)
2 lieutenants (1 NIB)
1 Al Rahaim
4 grenade launchers
3 melta guns
1 plasma gun
41 regular infantry (mix of all 6 poses)

Listen dude, nowhere did you indicate that shipping was conditional upon receipt. You asked for expedited shipping and I spent the 25$ to get it there by Tuesday. I asked for the same treatment and now you're telling me I have to wait? You're not even going to ship it until Tueasday? I don't know... that seems pretty weak man.

Let me know what you plan to do about this given your lack of notice re: delayed shipping... and in light of an ASAP promise given on May 15th and 19th. Incidentally, I’m assuming ASAP means as soon as possible, AS WELL AS with expedited (3 day) delivery service?

I'm very sorry for the miss understanding but at bartertown the lower rating ships first once the higher rated person receaves the package then they send out their part of the trade. When I said I would send your 2 landraiders, 3 rinos and the defiler ASAP I should have said that I would send them as soon as possible after receaving your end. If both peaple send at the same time it takes away that safety net for the higher rated person. I'm very sorry for the miss understanding and will remberse you for the shipping if that helps or I will ship the same as you did if you prefer. If you feel I have mislead you in any way Ill send your army back to you with a money order for $25.00 and I will still give you good feed back. Think about it and let me know what you want me to do.

well I called the Dallas customs peaple yesterday and they said they would look for our package and make it a priority. They also said that that could take up to two weeks I had no idea it could take that long . Crap you live in canada not Iraqe! I've got a freind who works for the Dallas customs athority and she told me they tell every one two weeks but it normaly takes about a week.

Jesus man, that is some bad news! I guess lesson #1 after the dust settles will be what the difference is between the 'R' and the 'D' on the shifter. Were your daughter and wife ok?

As for the models, it would be WAY faster if you just sent me the dollar value via paypal. The total then in Canadian dollars would be:

Defiler: $75
Landraider x2: $150
Rhino x3: $135
TOTAL: $360
+14% tax: $51

GRAND TOTAL: $411

I'm not sure what the hold-up is, but the order still hasn't arrived and the tracking number I got from CCG Armory (CJ210944963US) indicates that it still hasn't been dropped off at the post office in the US yet, let alone hit customs.

Any idea what's up? Can you do some prodding?

Additionally, given that this is an above the board item being shipped by a business accross the border, I'm expecting a pretty heavy customs bill when it arrives. Can I assume you will cover that in lieu of a paypal transaction in Canadian funds as I had originally requested, given your failure to produce the products as originally stated?

So despite having corrected my WRONG NAME AND ADDRESS when you wrote me to confirm these details way back on MAY 30th, you still provided the incorrect shipping information to CCG Armory. Hence, my package has been delivered to 117 XXXX, which I do not live at. By virtue of this fu%$-up, the delivery notice was left at 117, and I now have to go in and beg the manager at my local post-office to release Mike oroarke's package, for which I have no delivery notice, and no corroboration between a fu@&ed up name and a f#$%ed up address... otherwise it will be shipped back to CCG Armory.

I really don't know what to say here man. You fu@%ed up big-time. I shipped OVER A MONTH AGO, and still have nothing to show for it. If you hear nothing further from me, just assume I managed to get the package despite this SNAFU. Otherwise I will be in touch to follow-up on what you are going to do to ensure that my parcel arrives sometime in the next 2 weeks. You see, if the parcel doesn’t arrive within 2 weeks, I will be unable to receive it as I will be in the arctic doing research for 6 weeks, and we will have to drag this process out for another 2 months.

I had just returned from the post office having pleaded with them to release my parcel when I received a phone call from Moe. He was very apologetic and happy to hear that I got the parcel. Unfortunately one of the rhinos did not get shipped… thus the trade was still unfinished. Since then Moe has refused to communicate with me via bartertown. I have called his house and on three occasions spoke with him, each time getting the usual stream of apologies and assurances that things will work out. He even offered me $55 instead of the $45 he owed for the inconvenience, and said he would “do something to make it up to me”. Left with the daunting task of compiling this stream of correspondence I let it sit for a while, dreaming of a world in which people finish their trades… but alas it has come to this.

It’s obvious he meant well… at some point in time. His communication (was) very good, he contacted me out of the blue via telephone to talk about the matter, and he did send along the attack squad rhino box. But half way through the gong-show of a trading process he decided it was no longer necessary to fulfill his end of the bargain. I tried MANY times over a great many months to try and make this work, but to no avail. Hence:

I would strongly recommend that user: Assassin, aka: Moises Jacobo (warhammer4life@yahoo.com, Jacobolaurel@aol.com, 214-598-0397 of Mesquite and/or Dallas Texas) be avoided on account of his fraudulent behaviour within the bartertown community.

Please note that I am STILL willing to work through this snafu with Moe. I understand that things happen in life that can place our hobby on the back-burner. Moe was very open with me for the first while, but I need some sort of resolution on this matter, hence the reason I finally decided to post this warning. Should he follow up on his word and complete the trade, I will ask to have this post removed or at least modified. I will give this post 2 weeks to sit, then I will post negative trade feedback to be added to Moe’s profile.

I won't make any comments on his "truthiness" or lack thereof, in general
It seems, both, okay AND fishy at the same time.

I do want to clear up one thing, however.

Bartertown has NO RULES on who ships first. There is both, a common practice that the lower rated trader ships first, and a common misconception that it is a rule.

Also, it seems kind of OFF that there was some sort of 2 week delay here in the US and that he had to pick it up an hour away from his house. Some of the facts he sent you don't seem to be adding up. I also doubt he had to pay any customs on it. I'd ask for a receipt. I've received numerous large $$ value trades & ebay purchases over the years. All were properly labeled and I've NEVER paid customs.

No need for Paypal. Birthday card + cash = completed deal. If it's good enough for Grandma, it's good enough for him.

I'd hate to be this guy's postal delivery person with 2 hour round trip back to the PO :roll:

Thanks for your comments guys. To be honest I've never understood the stigma over cash in the mail... but whatever.

Okay and fishy pretty much sums up the entire transaction... save for the missing item which is less than okay and way more than fishy.

I've entirely given up on the customs angle and was just hoping to get the stuff I was promised. A bird in the hand.... Thanks for the info re: ship first 'practice' vs 'rule'. I won't get burned again.

Remember though, that although it isn't a rule, it is a very followed standard practice and MANY traders have that notice in their sig lines or initial posts. I know I stand by the lower/higher rule for all deals with everyone unless I have done a trade or 2 in the past with that same individual.

We all had lower ratings at one time. I know I did, and it took 3 - 6 months of very diligent trading to get my rating up to what it is now. Just be clear and up front with whoever you are trading with and that keeps everything understood from the beginning..

the stigma?

it's simple..
when a money order gets shredded, it gets replaced. [money orders are like bearer bonds. who holds them can cash them.]
when a check gets shredded, another one can be snet. [checks are like promisary notes, no money has moved until they're cashed.]
when cash is shredded, it's gone. you can insure it. [well actually you can, but it has to be sent registered, and it must be to or from a bank or collector. then it's like merchandise.]

also, there is the possiblity of theft; both long time employees, and the new temporary emplowwes and private contractors.

The "who ships first" thing is something that you both should have clarified before anybody shipped anything.

A couple things that raise my eyebrow:
- is there a pic of the jeep in the den?
- how about other pics / scans of the customs receipt?

Anyhow, this whole thing is wierd.

What, *exactly* do you want?

Be clear. Spell it out and send it to Moe, copy this thread. Then everybody will be on the same page.

It is a bad plan for random encounters admittedly, as the person has no proof of subission. But it is good enough for grandma... ie: it happens all the time.

to JohnHwangBT: Yup... definitely should have clarified shipping matters. Live and learn (note my modest trader rating). The Jeep and customs things are moot, as regardless of what happened he didn't have the models by shipping time. Basically, it doesn't matter if aliens came down and took them... the fact remains that he just didn't have them (for whatever reason). I'd rather accept that something bad happened than assume that he lied to me. It's nothing that I can prove and speculation will only lead to misery... and who is gonna pressure someone who just had a major accident at home? It's cash money we're dealing with... but it's just a hobby by comparison to someones well-being.

What exactly do I want? $45 Canadian... the cost before taxes of one Chaos Rhino. That's it. I'll take it in Polish Szloties, so long as the exchange is right.

As to spelling it out, I think the 3 months of clear correspondence on my part with Moe has been plenty enough. His attention has been directed to this thread (assuming he still checks his mail), so everyone is on the same page. I just hope the pressure of a community worth of hobbyists is enough of a persuasion to end this trade fiasco (and thanks again for all of the replies). This isn't even a major issue (ala: holy cr@p I got nothing in exchange for my 5000 point Eldar army!!), but I have been wronged, mail fraud has been committed, and I wanted the rest of the wargamming community to be aware of this potential hazzard. If I get what was promised in the end, all the better.

...and what do you do if he says he sent cash, but you never receive it? You gonna make him send that again, too? He'll bristle even further at that. If he sends it with any sort of receipt, confirmation or signature, that's gonna cost no small amount.

DON'T make a bad decision. Use PayPal.
Where's he gonna get Canadian currency? He's in the US.
That's a big extra annoying step. Plus, I don't know if ANY banks that exchange such small amounts, unless they happen to be the branch that handles foreign currency or in an airport (where you find your money exchanging banks most often).
PayPal does the conversion for you. Sure, there's a fee, but i'd call it "worth it" to have this thing settled that much more swiftly.

Yeah, that was totally my point. I don't care if the payment comes in foreign currency (ie: Polish Zloties), so long as I get the equivalent of $45 CDN for it in the end after conversion costs (ie: paypal fees). I shouldn't have to pay a fee to get the right amount of cash in lieu of a trade that never went through by virtue of someone elses failings... that's the proverbial salt in the wound!

I would never suggest a cash exchange... I'm just exasperated at the failure of Assassin to finish up his end of things, so I'd pretty much take anything about now.

at the post office, you can get money orders that are converted to canadian dollars.

there are 2 countries, unles it's changed, that you can buy money orders for, canada and mexico, other than us at usps. yes they cost more than US obnes, but at least you can get them.

Commendable, Assassin.
It's good that you had the sack to 9a) "Man Up" and admit your fault and (b) post it in the thread yourself, instead of PMing it to him and making him do it.

You might still get hit with a negative, to be honest, but -even with that- you'll be okay, if you just learn from this mistake.
