Possible new bad trader Jeremy Aebly

Jeremy posted a listing to sell some wood elves.

It sounded like a very good deal to me and I made the leap even though he had only a feedback rating of 2.

His listing was:
Wood Elves

2 Wood Elf Lord with Great Weapon
1 Spellsinger
1 Branchwraith
1 box gladeguard
1 box dryad
1 box gladerider
2 box wild rider
6 way watchers
1 wood elf army book
1 Warhammer case

We worked out a deal, I sent him the money with paypal and I received the miniatures very promptly.

But when I opened them, there was only 1 Wood Elf Lord and no Wild riders at all.

So $112 (retail new) worth of miniatures just didn't make the trip.
Since that time, I have emailed him 4 times, and left 2 messages on batertown. I am getting no replies and it has now been almost 2 weeks.

I have put in a dispute with paypal, I am hoping this will draw his attention.

If anyone knows Jeremy or knows of him, please let me know, this could be useful in my dispute.

My bad. Sorry, I've never done this before. I should have posted this first.

here is a copy of all the private messages we sent back and forth along with the date/time stamps.

Like I mentioned before he was very quick to answer emails, I thought things went smoothly and with no problems until I opened the package and there was just a few things missing.

Then it was like he fell off the planet. It may just be his computer crashed, or he went out of town for a week.

I could not find his original post, I think it cycled off. Not sure if the admin guys can dig it out of the archives. It would have been posted around Aug 8th to the 11th by Jimmy Loose.

I did, and for some odd reason was not given a tracking number on my invoice, it has a parcel shipping order number, which does nothing to track, so I have called UPS, and they said that I need to call back later today to see if it was assigned a number as of yet, but I will be sure to keep you in the loop.

He mentioned that it would arrive prior to, or at the latest Wednesday morning, but that he can't tell me if it is on schedule or anything due to having no tracking number. I actually just got off the phone with the UPS store that I shipped it from, and they are sending a request to the main office to see if the number is available. He said that when you ship something, the receipt generates a parcel order number, which is later turned into a tracking number, but that they haven't received the number as of yet. I'll keep on them though, hopefully I can have a trackign number by the end of today at the very latest.

Sorry so long for the response. I just moved and managed to open up your stuff and try to account for it all. I have it all out, and it just isn't all there.

You said there were 2 lords with great weapons, but I only received 1.
You said there were 2 boxes of Wild Riders and I received absolutely none.

I received everything else in great shape. What happened to the wild riders and extra lord??

That was the last of the communications. Maybe I'm jumping the gun here a bit. But I know the longer you wait on this stuff, the harder it is to do anything about it.

I did receive the package on or around the 25th of August. I moved that weekend and so it just got packed and moved with everything else and it was the 31st before I had time to open it and get an inventory of everything. That was why there was a delay between the final postings of us and me sending him the post on the 1st saying there was a problem.

I have not left him a negative feedback as I'm hoping we can resolve this without it becoming a huge deal, but I wanted to warn a few others before they made a deal with him.

This is really all I have. These messages, my word and my rating to back me up. I've been trading here for a bit, have a decent rating and have never reported anyone of anything before. Jeremy was nothing but polite, and answered every question and email quickly.
And all I'd really like is for him to either finish sending the stuff or give me a partial refund to make up for the missing miniatures.

Ben,

Just a quick question - why would you pay $100+ before receiving the items to someone with a -48 count ref difference? It doesn't seem to have been brought up in discussion and so I'm just curious....

I have brought it up in the past and when just paying for merchandise people are against sending anything before being paid.

I know this one was a bonehead move for me.

I've never had a problem before in over a year of buying/selling and trading on here. So I guess I'd fallen into the lull of 'it won't happen to me'.

And I am still hoping it was just an oversight that can be corrected, but I'm not holding my breath.

A couple of things I see here that you are not going to like to hear (read).

First of all, unless they have changed their policies, PayPal is going to hose you. You see, PayPal counts that as getting an incomplete or incorrect order. That is not the same as not getting anything at all.

Last time I read up on their policies, they did NOT cover it if you got PART of a shipment but not the whole thing.

In addition... and if I'm wrong, someone will correct me (I hope)...

UPS doesn't work like that IIRC. When I used them, the receipt that I got had a number on it and that number was the tracing number.
They put this big square(ish) label on it. I got a copy of that label & the tracking # was on it.

File with the FBI internet crime department (IFCC) and inform this loser that you're doing such.

Also, contact your local AND His local (very important) police department and inform them of the situation.

This is still fraud.

It may take some time but I have had Paypal refund my money on an issue like this. Half the items arrived and werent even the ones we discussed. It took forever and they could only refund me what wasnt spent in his account. Good luck

Well, paypal was useless as they said since I got something, they wouldn't touch it. Even if I didn't get everything I was supposed to.

This really pisses me off as there seems to be no way to dispute their finding.

I think the guy misread my dispute claim. As he was saying quality wasn't an issue.
I was saying it wasn't a quality issue, but a quatity issue.

I guess you live an learn.

i've had paypal hose me on ebay, i bought some minis that were 'well painted'. not only were poorly painted. 1 was missing an arm. 1 mini was actually broken, not just unglued. all of the minis were broken, because he threr 8 minis in a small box with barely enough bubble wrap to surrond them.

after 29 days paypal askes me to send them: proof of worth by an outside, independant appraiser, showing cost to repair. i had 1 day to produce it or be judged against.

they gave me only a fax number. no where to show pictures of the box. the missing pieces, the damaged pieces, or the outside of the box showint mailing cost. i paid for insurance, but he never purchased it.

paypal says, that it wasn't signicigantly different from the ad. all i asked for was the refund of the insurance fee. refund of the cost to buy a new piece, not even shipping cost from GW. cost to repair the broken minis.

1 week later they send me a form follow letter asking for my opinion of how the case was resolved. it was just check boxes and submit. no place for a response.


off subject. someone said there is a way to 'downgrade' you paypal accounts? i got stuck upgrading because someone wanted to pay with a charge cards at ebay and i either lost the deal or switched. now i have to pay on even deal i receive $$.

It was.

Don't ask me how, as I seem to recall it was quite a BEAR to find the spot.
As I remember, you're allowed to switch it TWICE so, essentially, you could never change it again after putting it back...

I'd say to go to the Help section and send them an email saying that you want to downgrade your account & can't find the instructions on how to do it. They'll email you & tell you how.

They probably pulled the # from their site, but I just called them and had them revert my account after a "bad experience" on ebay where some yahoo tried to burn me on a purchase for my wife ( :evil: ), then refunded with a credit card.

I'm finding it more effective to actually *call* people lately than rely on email. Could just be my curmudgeony self, though. :lol:

Next time, just a suggestion...

just say u did not get anything as I think this guy is playing the angles as he already knows Paypal policies befere he has done his deed and he knows their response.

just counter his move with one of your own. It is not right but unless you want to lose money it is up to you.

The other person broke the contract you are just trying to put yourself in status quo so you are not out any money.

Well... Now... yeah... You could do that....

Keep in mind that what you'd be doing in that case WOULD be considered Bank Fraud...
Which is a federal crime with a NASTY punishment...

You might want to contemplate whether or not that is really worth it.
