To whom it may concern:

I want to report a rip off artist. Our original trade agreement (include email from him) was on (May 16 2006). I immediately shipped my part of the trade. And I have never received what he promised to send me.

This guy (Mark Everheart)Has promised to ship 3 separate times since (May, 17 2006). I have tried to contact him a minimum or 10 times in the last 3 weeks, he does not return calls, and his last conversation said he had sent to the wrong zip code and would ship fed ex overnight the next day.

At this time I want to report him as a rip off artist and would like information on what if any recourse I have. This is my first time utilizig your website so I am not very pleased with the outcome. I will be reporting this transaction to the proper authorities and would appreciate any assistance you can provide me.

I'm not sure what proper protocol is here but I'm not sure I'm comfortable sending out my stuff, having you receive it, and then sending out your stuff. I was under the impression that when trading that you both sent stuff at the same time.

I only bring this up because you don't seem to have any trade references. For that matter, neither do I. It's just that I have no reciprocity if you don't send the stuff.

Let me know how you would feel comfortable handling this.

We will send on the same day(tomarrow). Then we will give the other his confermation code ok. That way no one is way nervous and we trade. Just one question though are all these the current ork models? The goblins should be commign in boxes of 20. I dont care really just want to know.

Yes, as far as I know they are the current Ork models. You're right about the Goblins it's a box of 20 for 40 total.

Your package should be there sometime today or tomorrow. I apologize for not sending you a tracking number but I short of *cough* lost it. Actually, my girlfriend decided to clean out my car and threw it away when I was at her house.

Evidently, I transposed soem numbers in the ZipCode on your package. Hence the reason it didn't show up at your place or my place for so long. However, since my return address was correct it showed back up at my house yesterday.

I'm traveling today but will resend the package via FedEx or DHL tomorrow (Thursday). I'll call you with the trackign number as soon as I have it. Please do not call me until then.

OKay... a couple things. You have probably figured some out by now, but I hope something will be helpful in the future, at least.

Everything here is "Buyer (or Shipper) Beware."
You have to cover your butt..

Did you actually speak to him on the phone before shipping?
What was his join date?

As a general rule, I would never EVER ship first to ANYONE with a rating below 10, REGARDLESS of my rating.

Did you try searching his name via google? Never know what you might come up with.

Orcdom... hopefully, he'll see this thread... Is from WV, IIRC. Maybe you'll get lucky & that area will be close to where he is. You might be able (but no promises) to schmooze him into checking into it for you, if he's local. He's a very straightforward guy.

As for reporting this... You'll need to file a police report with your local PD. Then, call HIS local PD and file one with them... it's amazing what a visit from the local cops will do to a scammer.
You'll also want to file mail fraud charges.

Regardless of what happens... even if he ends up shipping the stuff after you begin the process... FOLLOW THROUGH UNTIL THE END.
If you drop the complaints because he got scared & returned your stuff, he won't have learned his lesson and he'll probably do it again.

I ment to say that he has not responded to my phone calls. Not pm. Plus it would seem he didnt send them to me anyway. I have herd nothing from him but I will give it a couple more days.

What things can the site do should he not send? (Kick him off?)

People like to hide behind the internet and posts/PM's They are completly different people face to face.

I ask that This trader be removed from the site because it is obvious that he is not sending. He is late on his last reported shipping date and has not contacted me at all for a while now.

I think you might be jumping the gun just a wee bit Heath. Granted, the guy has had problems getting it shipped to you, but I wouldn't quite call him a scam artist just yet.

Keep in mind that "real life" happens. Dogs die and grandmothers eat your homework...

I'm a bit curious about the timestamps on the messages. It's like there are time shifts...how about organizing 'em into chronological order?
Secondly, it looks like some of the PMs/emails have been left out.
Additionally, the address he gave you for him is incorrect. It is 34 Ryan Ct. not Rams Ct. Here's the info

Give the guy the benefit of the doubt for a bit longer. After all, you are in contact with him and he does respond to your PMs.

Oh...one more hint. As long as you're getting responses from them, it is a good idea to keep your communications cordial and unthreatening. You'll find that people are much more apt to take care of you this way than with demands that come across as "Gimme my stuff or else!"

I fixed the order on it. I find it odd that that is the wrong address because he said he had recieved the stuff I sent. This was the one and only time I have ever spoken to him over the phone. the pms I missed are in there now.

If he was supposed to be sending via USPS, this is a LIE.
You see, and I know this because I have done it, when you take a package to the post office, they type in the zip code you put on the package. They compare this with the city on the package.
If these two don't match up, they point it out RIGHT THEN AND THERE. I know this. It happened to me.
Not only that, they will go through this huge, "Yellow Pages"-like book and find the right Zip Code for the city.

This guys is lying about that.

Now, it could be just a lie to save face, so-to-speak, for not getting the package out (didn't have the cash, or whatever)... but it could be indicative of something more heinous.

First, he "lost" the tracking number, then it HAPPENED to go to the wrong place?
Yeah... and monkeys might fly outta my butt!

As the old saying goes,"there's something rotten in Demark" but like Magical said He may be covering up to save face or a cover for a scam I say hope for the best but prepare for the worse. Start gettign to info in orde to make the nessassary reports easier on you and the police if they end up involved

When is it ok to ask to have him kicked off the site? From some of the last post that I have recieved it would seem like it is very likely he is going to not send.

I take that back... It's okay to ASK, but don't expect it.

Banning is not done at a traders request. It is up to the Admin level users to weigh the evidence and make that decision.

At this point, your best bet is to contimue to PM this guy once per day, call him if you have or can find his phone number on the internet - once per day, and stop asking for him to be banned.

Nothing personal... it's just that you're wasting your virtual breath with the request.

I have not even been able talk with the guy now for a while via any form of comunication. I did file the police report then called his local department. they said they stopped by his house but no one lived there????!!!!! If I had a guess at the situation I would say he moved and has been stalling me till he could do it. Either way I gave his local police his name and any other personal info I had on him but they had no Idea who I was talking about so I doubt he will take any punishment from the law. All I can do Is give him the worst trade ref. ever and hope for good trades from here on out. thx for the support guys both negative and positive.

What address did you ask the police to check?

If it was the address that he gave you, of course they didn't find him there. His addy is (according to the whitepages online) different from the one he gave you.
