First off, I have read the BTR rules and How to Complete a Bad Trader Report and am trying my best to follow those guidelines in this post. Let’s see if I can get through the process without getting slammed.

Introduction:

I responded to a post for a Hellcannon for 50% off and said I’d take it if it was still available. He got back to me with a total of $35 including shipping, which I sent on 03/27/12 via Paypal to this address:

After about 2 weeks had passed without receiving anything, I PM’d him to see if he’d shipped. He PM’d back “ASAP”. As of today, I still have not received anything, and have had no response to my further attempts to contact him.

In another BTR on him they are researching his true identity, etc. I made a post in that thread that I had also paid for and never received a hellcannon, and was rebuked by the admins for it.

I have disputed the payment via Paypal but wasn’t aware of that option until it had been 48 days or so. Others have said you have 45 days to dispute to get your money back. The dispute is open but I got a message back from PayPal saying that this type of transaction can’t be refunded, with no details as to why. My first guess is that it is because it is out of necessary time frame. Since he's in Canada and I'm in the US I'm not sure what legal action can be taken. It wouldn't really be worth the trouble from a monetary standpoint but sure would from a emotional and justice standpoint.

I would actually call paypal and talk to a manager.
If you can show that he was stringing you along to get out of the 45 day window, they may rule in your favor.
Something to try.

if you funded you paypal with your credit card you can get you money back. Just call you credit card.

Why did you wait so long to post this or do anything about it?

You may be in trouble, either way, with attaining a refund. PayPal is not going to help you at all. You have 45 days to raise a flag on a transaction. If that passes, you're SOL with them.
I believe it's 60 days with credit cards (they never were my specialty, though), so you could be SOL there, too.

I think like me, he figured that maybe custom was holding it up and he wanted to give the guy the benefit of the doubt. The only reason why I acted when I did was because I saw PP deadline of disputes.

I would still try and pursue it with PP and you CC company.

Yes, because of his high rating and figuring he was in Canada, I didn't really start to worry until more than month had passed, and by the time I was pretty sure it was right on the edge. Writing up a BTR right takes some time and effort, and between work, normal family duties and a vacation it was pretty late by the time I was able to complete it. I wanted to do it really just to add more weight to the existing ones. Plus I suppose it helps to vent a little. I think it's probably too late for a credit card dispute too but will check. Since the actual dollar figure wasn't that high ($35) I'm really more concerned about justice than the actual money, though I would certainly like the money back. I went for what seemed like a good deal because my hobby funds are tight, and losing 35 bucks doesn't help. If I don't get the money back that's my own fault for not investigating my options in a more timely manner. I'd sure like to see the *bleep* punished for what he did somehow, though. Poophead.

Did you send the money as payment for goods/merchandise, or did you do it as a gift? If you did it as a gift, you're hosed anyway since Paypal views it as just trying to get around their transaction fees.

Most credit cards work on a 90 or 180 day charge back term. Contact your credit card immediately since you are just about to the 90 day point.

In the future, though, please refrain from name-calling. As minor as it may be, we don't want precedents started.

As Imaginos said, go straight to your Credit Card company, and do it fast. PayPal won't like that, but who cares.
