Bad Trader: scionofjustice AKA Shelly Varnedoe / Kyle Stout

Post by Timbor »

I wish I didn't have to report this, but I think that it is best to do so. In late april, I agreed to pay scionofjustice for him to send me 93 metal O&G snotlings in the mail. I sent the money by paypal on April 27. He contacted me on May 11 saying he had shipped it a while back, and had been very busy. I PM'd him a week ago (June 1) asking where the package was. He was shipping to me in Canada, and I had asked for shipping via USPS (cheaper, non-ridiculous brokerage fees). The package finally arrived last Friday (June 4), but had been sent by UPS and I was billed a relatively large brokerage fee. The UPS tracking said the item was accepted at their office on May 28 (1 month after sending payment and about 2 weeks after he messaged me saying he had shipped). In the package were 82 (not 93) snotlings.

So, from my experience, I did receive an item, though not as was described, shipped slowly, and shipped via the wrong courier. I sent another PM today to see if he is willing to make this right. If I do not hear back soon, I will post a full detailed BTR - I just don't want to give bad feedback until I have given him a chance to make things right. I have a name and return address on the parcel - if it is deemed proper for me to provide it, I can do that if it helps you out.

Here are our communications:

I am interested in some of your snotlings. Not sure how much you would value all 93 of them? If the price was right I would be interested in all of them, but otherwise maybe half of them. Are they all unpainted? Where are you located, will you ship to Canada?

Thanks,

Tim

Its best if you ship via USPS, as the courier services tend to have expensive brokerage fees. I've had lots of luck getting stuff sent to me via USPS. If you can confirm when you ship, that would be great!

Thanks,

Tim

Still waiting for the package arrive. What date did you send it out? I'm assuming its stuck in customs or something and hopefully it will show up soon. Would you be able to scan a copy of the customs receipt you got when you mailed it? I'm thinking of contacting USPS to see if they have processed it yet. I know there's no tracking, but there should be a number that they scan when it passes through customs.

Thanks,

Tim

Timbor wrote:Hi there,

The snotlings came in the mail finally, however I have a few problems I would like you to address:

First, I specifically requested by PM that you ship via USPS (united states postal service) since couriers have expensive brokerage. You shipped via UPS (united parcel service), and I had to pay $20 in brokerage fees - that's an extra 50% over what I paid you. With USPS, packages rarely get charged brokerage at this size, and if it was, the max payable would be roughly $10.

Next, your ad stated that there were 93 metal snotlings. I counted today and found 82. One of them was two snotlings on piggyback, so you could stretch it to 83. Did you forget to mail 10 of them, or did you possibly miscount them before shipping? I agreed to pay you for 93 metal snotlings, not 83.

Finally, on the UPS tracking website, it lists the item as being scanned into the system on May 28, 2010. You can confirm this at UPS.com using the tracking number 1Z340X216891452748. You sent me a message on May 11, 2010 stating you had already shipped the items. I really don't know what to make of that. I sent the money to you via paypal on Tuesday April 27, 2010. Can you please confirm to me when you actually shipped.

I do not wish to file a bad trader report about you, nor do I wish to file a claim via paypal for missing goods, so please respond to me as soon as possible. I would like to know how you plan to make this right. I look forward to hearing back from you.

Thanks,

Tim
The last two PMs have not been read by scionofjustice. I filed a claim with paypal, but I filed it after the 45 days, so it won't be investigated. The point I am at right now is that I had to pay UPS brokerage, which amounted to an extra 50% of what I paid for the minis, and not all of them were there. You can check the UPS item online using the tracking number 1Z340X216891452748

I should bring attention to the return address listed on the package. The minis were in a box with a return address labelled:

Shelly Varnedoe
15151 NW 150th Rd
Alachua, Fl 32615
USA

The package was in a UPS bag with the return address:
Kyle Stout
Apt 2070
15151 NW 150th Rd
Alachua, Fl 32615-5559

If required, I can take pictures of the packages as confirmation of these addresses.

If you are familiar with recent BTRs, Kyle Stout has appeared in several of them:

viewtopic.php?f=34&t=99254
viewtopic.php?f=34&t=99239
viewtopic.php?f=34&t=98802

As noted in my PM, his paypal address is adhesivespatula@gmail.com - I make the link because of the BTRs I just referenced were for the user name adhesivespatula.

I have not yet left negative feedback. In the rare chance that Kyle/Shelly gets back to me in the next week and refunds me a bit of money, I will leave a neutral feedback.

Hopefully this will serve to warn other people if Kyle decides to make another account and trade some more.

Good to know. Would my case be worthwhile/acceptable to pursue as mail fraud? I wasn't given a real name from scionofjustice, only what was on the paypal receipt and the return address. I did receive 90% of what I paid for - think it would be worthwhile to file a claim for $10USD of missing goods? I know they wouldn't bother with the wrong shipping method... Would me being from Canada make things more difficult?

Both agencies will tag the name, and the more a person is reported, the more likely they will get pinched.

Sounds like a plan. Does the USPS link cover only mail sent by USPS, or do they also investigate courier mail? Just wondering since my parcel was not sent via USPS.
