Bit of advice needed.

okay first and foremost I want to say a few things and thank a few people.
first and foremost all the staff and Lin for letting me come here the past 2 years and really increase and streamline my RPG and mini collection for free.

I have had dealings lately with one trader here and i wont mention names since the trade isnt gonna go through and wont techinically be a bad trade.
But it has so soured my taste for trading online that i am gonna have to give it up for a while, maybe indefinitely.
sorry to rant but i am ready to choke someone here.
what i really need to know. is this. I am gonna refuse the package and send it back(to canada) but what is the best to watch my back legally?
not wanting professional opinion just advice. I dont plan on opening it or breaking the seal at all. just sending it right back the way it came just as it came.
he paid shipping here I will pay to send it back.
I worked my way up from a 0 rating by sending first paying first and yes i have sent my share of idiot PM's when i first started.
we agreed for him to ship first (200 us dollars + worth of stuff) and he said okay. I said dont ship till the 15th of august as i want have the funds till then. he ships early and i tell him that i still wont be able to pay till then he says okay. then fromt he moment he ships it i hear over the PM channel. can you send the money early i shipped it. i am like no, but we do discuss that i can pay extra at of my own pocket above and beyond what we agreed and electronically wire the guy money via western union.
there is a store near him and apparently thats okay, i guess. but time and time again he keeps pming wanting money early i am like no it will be as agreed or i can just not recieve it and send it back. Then he starts saying he has to have the money by a certain date and so on so on.
I HAVENT EVEN SEEN THE STUFF YET!!!! OKAY HOW CAN I POSSIBLY SCREW THE GUY IF I DONT HAVE THE STUFF? OH MY GOD I NEED A BEER.
anyway. if i just send it back unopened is that still open for mail fraud? I mean i wont to follow the law here and not jerk the guy around like i feel like i have been.
sorry for all this ranting just to ask one question.

forgot to mention i will complete the other trades i am in with the other 2 guys. then poof.

I would say - when you get the stuff, keep it and pay when you agreed to pay. You have a verbal agreement and there is little he can do. If he sent the stuff early, its his fault.
Dude, go get a beer and sleep on it. Don't let it ruin your experience here. Anyone who has more than 20 trades has had this happen. You have to take the good with the bad. The more you do, the chance gets higher you will have a problem. it happens, life goes on. Sure your pissy for a couple of days and you think - screw this, I'll never trade on line again - blah, blah, blah.
Do you like playing games with little play army guys - then stick around, it doesn't get much better than this and the people who have been here awhile are part of a special group of gamers. You are part of that group, don't let one crazy transaction cause you problems.
Also - send a PM telling this guy that you will live up to your end of the deal when you said you would and to stop bugging you. Notify the pants, the insidius, etc. and they will send a warning. If he doesn't follow up, he will get his just. I hope he doesn't have a high rating.

Dont let it get you down just pay on the date you agreed to dont worry about it.
and dont let anyone run you off trust me its not worth it i have lost money a few times but i always do right by the people i trade with in the end.
and i would bet money there are alot more here like me

you about needing the money sooner, and so forth when he apparently already knew about, and agreed to, your financial request? This is not appropriate behavior.
Before you vanish into the Aether, please post the PM conversation that you had with this party, or send it to me via email. Did he provide you with any sort of tracking notification so that you knew the stuff had already been sent?
I'm going to withhold judgement until I see exactly what was said, but if this person is harassing you to pressure you into paying early I will not stand for that. We work too hard to have bad apples spoiling trading for everyone who works hard to build a decent rep.

It echoes my sentiments and makes me feel better about saying what I intended... which I will say now.
First: Keep it and pay when you said you would, or write "Return To Sender" on the box in big black letters. Take it to the post office and tell them that you are refusing shipment on the item. Whichever you prefer,
Do NOT pay to ship it back to them. Let the postal services return it.
If you keep it, do NOT pay for it, unless it is what you were supposed to get, in the CONDITION it was supposed to be in.
If not, repack everything EXACTLY as packed when shipped to you, using the same EXACT packing materials (no more, no less -- so it weighs the exact same amount), then follow the "return to sender" instructions I posted above. Make sure you tape the box closed securely beforehand.
Secondly:
IN MY OPINION (wanted to stress that), the very behavior you describe should be something that qualifies for a negative reference AND a Bad Trader report. I know that Bad Trader reports are pretty strict, moreso than negative references, but this kind of bahavior (by your own decisions) proves to be the stuff that chases away good traders and SHOULD qualify the recipient for a Bad trader post,
as well as a negative reference.
Not to mention that it is suspicious, since he's telling you to pay him before you receive your goods, though your deal was otherwise.
I don't know who you dealt with (and I hope you post it as requested by Lin) but, if your allegations prove to be true, this guy COULD be scamming you.
Don't let one bad experience sour you on BTown. I've had 3 or 4. One was REALLY bad, another one... I'm still deciding how to handle...
If everyone who had a bad experience left, this place would be a ghost (barter)town.

I believe that once you open the package, you are no longer allowed to have it sent back without paying return postage.
Edit: My comment refers to the USPS; other carriers may have different policies.

I live in Canada and you can always refuse a package, by putting return to sender on it. It is not mail fraud. You are not depriving them of their goods. The company I work for gets all sorts of packages sent to them from people in other parts of Canada consiting of unordered ink, paper toner etc. It gets sent back. They call up and demand payment and threaten us with legal action if they are not paid. It never goes any where, especially after the problem is handed over to. Generally one "bite me phone call #$%$%^% gets the job done. You had a verbal agreement to do something, he is choosing to ignore that is his problem. I would not send any money until the package arrives if it does.
just me two cents. If you do send it back unopened he is out his shipping, but I would look at it as a jerk tax.

That, of course, is assuming that they KNOW you opened the package.

...not that I'm encouraging anyone to be less than honest, mind you. I would never (openly) do THAT!

truthfully if you just dont want to deal with the person, you can refuse the package, but that is bad taste. i personally wouldnt stoop to that level unless i had no other choice.
i had something similar happen i was having an agreement on a trade, and told the guy iu could get something he was lookig for but if i bough them he would have to buy all or trade for all, after i bought the stuff he backed out once he made a verbal agreement.
i got pissed and let him know so, a verbal agreement is your word, and technically trading through pm's and emails are sorta a written contract.
then had another back out on a trade once it was agreed on and was ready to ship.
sometimes i hate noobs.
but what this guy is doing by hounding you because he shipped first, is his own fault, all i would reccomend is if your wanting what you agreed on, go ahead and make the purchase. but agree on no trade refs because this guys intentions might be to screw you that way as well. at least you forewarned the mods incase someone nukes your trade refs.

What I INTENDED to say, but got too caught up in the typing and attempting to hurry was that you could do that
IF YOU WERE GOING TO BE DISHONEST WITH THE POSTAL SERVICE. Which, of course, I would never
EVER recommend to ANYONE.
