I had closed a deal with a user a while back. Considering his/her references, I asked him to send first. There was no problem so I gave him my address. Once the items were to arrive, I would be sending cash via paypal. Here is my issue. I sent this user my address over three weeks ago. I still have not received my minis. We both live in the states, so even with first class time shouldn't be an issue. Once per week, I have sent this user a friendly PM just reminding him that my package has not arrived and that money will not be sent until then. Those messages have gone to my "sent box" showing he has read them, but I have not received a single reply. I have the money sitting in my account waiting to be spent. I have now come across another trade in which I'd like to use this money. Do I call this previous trade off? The only reason why I am asking this is because no replies have been sent regarding my concerns with this trade.

Looked up some details. The exact date I sent my address was April 22. He has completed two other trades since then. He also has one negative reference dating April 13. When diggging through my inbox, I remembered this guy tried to buy some SoB's off of me on April 30. That day, I had sent an additional PM reminding him of our first deal. Again, I have not received any pms from him since his request of my address.

I would assume that the other party doesn't want to deal.

You can do a variety of things, depending on whether you really want to push for the deal, or you're OK walking away.

I would probably send a note asking if they intend to go through with the deal, and I would put a deadline in it: "If you do not confirm our sale by Friday, May 19, I will assume that our deal is off and buy from someone else. If you send after this date, I will treat it as a FREE GIFT." I would require them to provide a tracking number if he's going through with the deal.

That way, it's very clear where you're coming from, what your intentions are, and what you're expecting. The most important thing is that you communicate things so that they know.

The problem is that I need to close this newer deal within a day or so. Otherwise the item I am trying to aquire is hitting ebay. At this point I am pretty much willing to call the old deal off. Lets run this scenerio - If he sends it anyway without giving me notification, I would gladly send the items back. Of course he would have to pay me shipping. I would hold the items for X weeks until I receive shipping compinsation. After that, the items are mine at no cost. Of course this would be sent via PM. This wouldn't be a big deal if my PMs were unread or if he has lost connection to the internet. But being that he as tried to buy other items off me after this deal and that he has already completed other trades after April 22, I could consider our trade void.

You've made every reasonable effort to contact them. Just move on and take care of the more pertinent deal while you still can.

In that case:

1. Plan to move forward with the new deal.

2. Send the note that you've assumed the old deal is off, based on non-communcation, non-confirmation.

You've been fully open the entire time, and you've made the honest, reasonable efforts to communicate.

Got to agree with arch_8ngel. Given that he hasn't sent his end and seems to be ignoring you, i would assume he isn't interested. If there was some delay in him sending his end, he should have said something, especially since you've asked multiple times. There's not much else you can do. If you do go with the other deal, you should definately CYA by sending him a PM to say that you're breaking the deal.

As chance would have it, i know who you're talking about. I have a deal pending with him as well. He's supposed to buy some models from me. It's been a week since he told me i would be receiving payment and i haven't heard anything. I sent him a reminder ealier today, but based on past feedback and your post now, i'm not very hopeful that this deal will work out. So if it's any consolation, you're not the only one.

Well, now, I don't know who you are referring to... and I don't know his ref's.
Here's what I DO know...

First off... you weren't made a mod for no reason, Al.
You know the scenarios. What is YOUR take? Especially now that a second person has had similar dealings with this person?

It is a typical scammers ploy... He tries to deal with as many people as possible, hoping to find some who are willing to ship first, finding others who will send after he sends the PM saying "I sent my money order 2 weeks ago. Send my minis or I'll post feedback that you are trying to scam me (or some such).

A few people fall for these scams & he's "up" a few models (and/or dollars).

Send one PM saying to him that the deal is OFF.
Make your other deal (in that order).

If the package arrives, DO NOT open it, refulse shipment ans "merchandise not ordered' or something like that.

You're set.

It is already taken care of. I forgot that I can refuse the package. USPS will send it back and charge him for shipping anyways. :P I'll be honest, I have never come accross a bad situation with a "closed" deal. Or where I had to consider leaving a negative feedback. 110+ points and I only had one mishap but on my behalf. Either way, it was fixed and was a positive trade. Otherwise all my other trades were pretty much text book.
