Reply to ITL?

Is it possible to reply to an ITL? Reason expressed below:

I made a trade with someone, it got shipped late, was horribly packaged (an entire army in a rollerblade box, with 2 socks and 6 paper towels as padding, there were 5 unbroken models), and it was missing pieces.

I figured up the cost of the missing pieces on a sprue by sprue basis, then emailed the other party back telling him he had 2 options:

1. Pay me return shipping
2. I picked two units with a value equal to the missing parts and told him I was willing to keep those and ignore the fact that almost all of the models were broken.

My ITL is not that high right now (his is 0), so getting a bad rating from him (which he can do no matter what he does) is almost certain. Is there a way for me to contest it and/or respond to it? My ITL to this point is glowing, and I would like to keep it that way.

Undeserved/retaliatory negatives are a serious "NO-no" here and are militantly frowned upon.
I feel (and, any Mod, feel free to correct me if you disagree) that a negative ref. on the ITL, in retaliation for a DESERVED negative ref would be cause for a Bad Trader report.
A Bad Trader report would be, IMO, the first step towards getting the negative expunged.
It CAN be expunged but you must be able to prove WITHOUT A SHRED OF DOUBT that you didn't earn the negative ref.

Do you have a digital camera? A GOOD camera (not a web cam)?
If so, take a slew of GOOD QUALITY pics of the minis you received.
Use those as proof should a disagreement arise.

That being said... did you send yet? If not, then tell him you REFUSE to complete the trade. Tell him you will ship the minis back to him but it is NOT your place to have to eat that cost. Tell him he can send you enough money to pay to ship the minis back to him, or you can ship them back C.O.D., with the C.O.D. cost being the total amount of shipping, plus the C.O.D. fee. Don't ASK him if that is what he wants. TELL him that those are his only two options.
Give him his choice of shipping options (parcel post, priority, insurance, delivery confirmation, etc.).
