Seeking Legal Action vs. Jim Huston (icbhod)

Post by David Phillips »

Hello all,

After much time my saint like patience has come to an end. I traded to Mr. Huston a painted Tyranid army back in July 2005. This was my second dealing with Jim (the first one being fantastic). After various delays due to Hurrican Katrina and job problems I have now lost contact with him. I'm still in the process of printing off the numerous pages of contact info I have so that I may file charges with USPS and Local Law.

I've posted much of our communications below. It took me over an hour to get it in the format it is now. Still need to tighten up some.

If, for some strange reason, you wish to read it. Start at the bottom and work your way to the top.

Good Gaming/Trading,

David

It does indeed. After busting our humps to get all of the stuff changed over
so that we could "pull the trigger", the deal fell through about an hour or
so before the signing deadline. We thought it might just be delayed but now
they are unchaining the lawyers so I suspect its not going to happen.

Looks like there will be cash bound your way in about 10 days at this point.
Not sure of the exact amount but it should be at least $150.00

Please send me the PayPal information again.

I wanted to make certain that you got my response to this mail and I also
need to relay a bit of bad news.

First off, I have a few home made Cyborks made from Necron parts.....they
ar! e
painted and look! rather nice. I don't have anything else painted that
you
are
looking for.

The bad news! is that I will be unable to send you any cash this week.
The
simple fact of the matter is that I don't have it to spare. I am waiting
for
some money to come in but, until then, I had to send my wife and kids to
Florida to attend to some family matters and so I am strapped for cash.

&g! t;I get paid in 2 weeks (which was when I was planning to send you the
second
installment of money) and so that's when I will be able to send the
first.

I apologize for the delay but its all I can do. Later this week, if I get
some of the cash that is out standing, I may be able to send you
something.

Jim Houston
I do understand and I certainly appreciate your position. I like to think
that I would be as patient as you have been throughout this issue.

The money should be in your account on or about the 19th.

Hello Jim,

I agree with you. The easiest way to deal with this is PayPal. My account
name is the same as my email.

I really had no desire to follow through with my threats since our
realtionship has been good one. I hope you understand my reasoning for
getting this over with.

I'll look for the notification on the 19th.

Take care,

At this point, with the desire to get this issue resolved, the best bet is
going to be for me to pay you for the bugs. I have been, and continue to
travel a great deal (just got back yesterday and I am out again Monday) so,
what I would like to do is pay the $300.00 via PayPal on 6/19/2006.>

Hello Jim,

It's been two months since I've last heard from you. I've been patient but
that has to end since it is comming up on one year since we did this trade.

Here are you choices as I see them:
1) Pay the $300.
2) Send a painted Ork army.
3) Send back the Tyranid army. If you do this I would appreciate you
taking
pictures so that I do not have to go through the hassle of unpacking them
all
and taking pics again.

My preferance is number one or two but I will settle for three. I expect an answer very soon. If I do not recieve any word I will have to
start filing fraud reports with the Postal Service and the FBI. I do not
wish to do this but I have to do what I have to do.

I know that you have had an unexpectedly bad year but we need to get this
settled.
Talk to you soon,

OK, looks like the best way to handle this is going to be cash on the
barrelhead. Once again, I just returned from Louisiana yesterday
morning
and
I am heading to South Carolina Monday so, let me reconcile my
expenses
from
this last 2 week trip and figure out how broke I am, get my expense
report
turned in and I should be able to let you know by Monday if I can
send
you
the cash then.....I should be able to.

I apologize for all of the hang ups but it has been way crazy here.
Like
I
said, just back from another 2 weeks in N.O. the out to South
Carolina
for
a
week, back to N.O./Mississippi for 2 weeks and then a week in Orlando to
kill
off March.
I will be glad when this is all over. I have not played 40K in
months!
We
will have all of our stores reopened by the 2nd week in April and so
my
life
should go back to a normal Monday through Friday 9A - 4P

Thanks for your patience in all of this.

Generally, I am not on the road this much but when Katrina hit, it hit
us
hard. We have a large store segment in the MS and LA area. The
storm
closed
23 units and we are now down to the last 6 stores to bring back on
line.
I
probably have another 90 days or so of frequent trips to the
hinterlands.
Thanks for your understanding in this whole ugly mess.

I will do my best to enjoy my time home.

Hi Jim,

I tell ya man. I'm glad I do not have your job. I just can't
stand
being
on
the road that much.

Tell ya what, if you are up for a cash deal I will be as well. As
much
as
I
would love to have the Orcs I feel that I could use the money a tad
bit
more
to flesh out my Dwarves (especially with the new book/figures
coming
out
in
January).

Shoot me an email and we can kibitz about the deal.

Enjoy your weekend home.

I just got back from N.O. again. I will be in town for the
weekend
and
then
back to work on another of our stores. We still have 6 stores
that
are
out
of
commission and we are having to redo their entire network
infrastructure
as
well as restore their broadband connectivity.

As I'm sure you will appreciate, I will not be doing anything
with
the
Orks
this trip home in favor of spending time with my family.

If you want to move this to a cash deal, I would be good with
that
but
its
gonna be after the holidays before I am in a position to do it.

Let me know where you stand with that idea and we will get it
worked
out.

Hello Jim,

Since I don't really want to go through the hassle of
selling/trading/shipping the bugs again I'm willing to wait for
the
Orcs.
And since I have zero time to paint I'll have to wait until the
Orcs
are
painted.
On the other hand, if you have the funds you could purchase the
bugs
off
of
me. I seem to recall that I asked for $300 even. Just throwing
that
out
again as an option.

Hope you are able to get things going again down there. I do not
envy
you
the time on the road.

Wanted to send you an update. I just got back from N.O.
yesterday.
I
will
be
in town for a week or so and then back down for another few
week.
We
still
have 8 units that are closed due to flooding so I have no idea
how
long
this
back and forth will go on. The most optimistic projection is 90
days......I
apologize for the delays. Again, if you want me to send back
the

I'm sorry that I have been out of touch for this long. I work
for
Shoney's
LLC and we have a large number of stores that were in the
area
hit
hardest
by
Katrina. I have been in and out of the hurricane zone since
the
storm
hit.
I
got back to Nashville last night and now I am scheduled to
head
out
again
some time this week as we attempt to re-open store and they
need
to
have
their networks re-installed and VSAT systems brought back on
line.
To
be
very
honest, it will probably be some time (Days or so) before I
am
able
to
get
back to the painting of the Orks.
In the interest of fairness, I am willing to stick with our
deal
so
long
as
you are cool with the delay we have had, send you the bugs
back
and
call
the
deal a wash or send you the Orks as agreed less the
painting.....you
let
me
know which route you would like to take and I will make that
happen......so
long as I hear back before I leave again.

The bugs have, in fact, found their way home. The >
devourer has come home to roost. I just got back in
town like 10 minutes ago. I opened the box and,
against all odds, there were things broken off.
Mostly off the large models and they were things like
arms that just need to be glued back. The ends of a
few talons broke off but they can also be raired
with ease.

I'll need to hold on to the Tyranid

Sorry to hear that Thomas.

I'm still in the process of cleaning up over a years worth of correspondence but I'll be getting things together as soon as I can.

Post here and shoot me an email at g_digger@lycos.com to give me an idea of what's happening.

I've left Jim a PM and an email to both of is accounts (work and home). Plus I've given him a link to this thread.

Good trading/gaming,

David

1. File a police report with YOUR local police AND HIS local police. This is VERY important. When a detective is assigned to your case, write down his name and contact info. Keep in touch with him about the case.

2. File a mail fraud report with the USPS, assuming that was the carrier.

3. File an internet crime report with the FBI, via the links in my signature.

Follow these three steps and be patient. Let Ichbod know what you are doing as you do it via email. Keep records, delete nothing.

Thanx insidius,

I was unaware that I needed to contact police in my area. What is the reason for this?

When it's an internet crime, it falls under both juridictions, I was told, since you live in different areas.

Hello all,

Since starting this thread Jim Huston has contacted me. I have recieved 1/3 of the money owed to me with a promise that more is to come. As such I will hold off doing anything for the moment.

DarkSoul,

if you need any info from me please let me know and I will get it to you.

Thank you for all those who have helped. I will update this thread as things occur.

Good gaming/trading,

David

he also just posted, with in the last couple days, since this thread started, looking to buy or trade again. i guess he figured out that with this many 'open' deals, no one would deal with him until they were rectified.

Assumptions ina vacuum

Post by icbhod »

.......do you know me? Have you ever traded with me?

I thought not.

The simple fact of the matter is that David Phillips and DarkSoul are the only ones with whom I have had difficulties. They have been on my end and I take full responsability for them.

Please do not speculate on what motivates me as I do not speculate on what motivates you. My trader reputation (until these) has been flawless......perhaps it would be best to wonder....."what changed?"...the answer is circumstances.

So, please, this issue is being addressed and the one with Darksoul has been completed and, in light of this I would ask that you keep your theories to yourself or feel free to contact me in a PM and ask what the deal has been with these trades.

Were you to inquire, you might find out that I had actually sent a mail to David last Wednesday (although he for some reason did not receive it....I sent it to him again) letting him know that I would be making a payment to him....that would be prior to this posting.

David, again, I appologize to you profusely......Darksoul, thank you for your patience in all of this.

Doesn't mean the thread will go away. It could end up locked, but I doubt it will just disappear.

.......and where did that come from? Nobody said anything about doing anything with the thread......unless I missed something.

Bad trader forum rules do not just apply to the creator. You want to actually defend yourself prior to this thread being started. Then post proof otherwise don't bother posting your own accusations or defensive ploys.

I guarantee you that this thread is not going anywhere.

Here's a tip for ANY persons using e-mail for communications with trading. Use outlook or outlook express and attach a Request Read Receipt on every email you send. Then not a single soul can ever say “I never got that email.â€
