BTR: jbarket (aka Jonathan Barket) - resolved by jbarket

Post by StarmanTTLB »

The following BTR is for a deal between jbarket and myself starting 9/6/11.
jbarket
Jonathan Barket
8 Flag Road
Little Rock, AR 72205
The deal was a trade: I would send (2) Warhammer 40K Chimeras (assembled and primed), and jbarket would send (2) units of Warmachine Doom Reavers (6 model per unit, assembled) & (1) Warmachine Greylord Escort (unopened blister). These have comparable MSRP, so we would do a straight trade and each of us would pay our own shipping.

=============================================================================================================

The thread itself is lost to time (as of writing this BTR, my relevant post in the Warhammer 40K forum has disappeared due to inactivity). jbarket messaged me first via this post to trade for the Chimeras, offering the Doom Reavers which I had listed on my wishlist.
jbarket wrote:Sent: Tue Sep 06, 2011 5:19 pm

Tier 4 Butcher is madness sir, it's madness!

I had considered it for a while, so I've been filling out larger trades with Doom Reavers for a bit, but they just aren't a priority these days. I'll have to check when I get home, but I have at least two squads and an unopened Greylord Escort.

I traded on Dakka for Fenris and two more squads when Bartertown was down not long ago and got ripped, so my mental count is a bit off.

Anyway, I'd be interested in both of your Chimeras. I prefer to trade roughly MSRP retail for MSRP retail, so that puts you at $70 for two Chimeras, and me at $73.97 for two squads of Reavers and the Greylord.

What do you think?

Oh also, I don't know if you own any Reavers already, the weapons on them are very filmsy. One of mine, and at least one I've received in trade has come off. The swords are very easy to glue back of course, but I want to be up front about the quality.
StarmanTTLB wrote:Sent: Tue Sep 06, 2011 6:06 pm

Madness, my friend, is the whole point!

I'm proud owner of 3 units of Doomies right now, with a 4th in the mail (thanks to Bartertown!). One of the units came to me entirely shattered (face-to-face trade, and they were just tossed into a ziploc bag!), so I've had to do my share of repairs. I'm completely unworried about pieces that have come apart at normal glue joints. Pieces that have snapped in bad locations (hands off of hilts, for Doomies) are more of a pain!

To be likewise upfront, I believe a bit or two has snapped off of the Chimeras (like searchlights or antennae). The vehicles and the weapon barrels themselves have no damage. If you're interested, I can dig around in the ol' bits box and try to send along whatever Chimera bits I can find to try and replace the snapped accessories. If that isn't kosher, we can work out a small monetary compensation on my part to make up the difference.

Oh and FYI, these are set up as multi-laser turret, hull heavy bolter, and smoke launchers. The aforementioned searchlights and antennae (woo improved Deep Strike!) are the missing bits, so I don't bother listing them ^^

Sounds perfect. It's a trade sir.

One word of warning, I am not the fastest shipper in the world. I keep a weird schedule, so I usually pack them up and end up sending them off with my wife or my mom, depending on who I can convince on a particular day, haha. So it may be the end of the week by the time they go out.
Slight worry when I read the above post - jbarket says that he isn't a fast shipper and can't always get them out reliably.
StarmanTTLB wrote:Sent: Thu Sep 08, 2011 6:33 pm

No worries - due to real life, I haven't seen BarterTown until now, and won't be able to get the package out until tomorrow :'(

No problem at all! I'll get it out ASAP
StarmanTTLB wrote:Sent: Fri Sep 09, 2011 8:49 pm

Sent today via USPS, DC# 03111660000000960065. USPS shows an expected EDD of 9/15.

I included the bag of misc chimera bits, it's basically everything I could find for 40K vehicles in my bits box.

Showed up today. They're super well built and in great shape, couldn't be happier.

Let me know when my stuff gets there. It went out this morning. I'll dig up the tracking number when my wife gets home.
jbarket first mentioned that he HAD a delivery confirmation number, but never posts it.
StarmanTTLB wrote:Sent: Sun Sep 18, 2011 6:52 pm

Still haven't received anything - do you have a tracking number?
As of writing the above message, I see that jbarket was last online on 9/15. This means that he had 4 days between supposedly sending my package and his last appearance, and nowhere in there did he post a DC number.
StarmanTTLB wrote:Sent: Tue Sep 20, 2011 5:27 pm

Still nothing... Do you have the DC? I'd like to see what the USPS says about the delivery status!
StarmanTTLB wrote:Sent: Tue Sep 27, 2011 7:33 pm

Jonathan,

Your profile shows you were active on BTown as of 9/25. If you don't respond to a PM in the next two days, I'll be messaging the admins and posting a bad trader reference on our deal. I hate to be unpleasant, but I also don't enjoy being ripped off.

Please get in touch with me and provide a Delivery Conf number for the models you owe me.

-Jeff
=============================================================================================================

As of the writing of this BTR (10/1), jbarket hasn't responded to me since 9/12. He's been online AT LEAST on 9/15 and 9/25 (according to his profile, those were dates of activity), and may have been on other times, so he HAS seen the messages.

No money changed hands, so I can't pursue that kind of action.

I haven't yet posted a negative reference, but intend to once this BTR has been looked at.

I have no idea how to proceed, as I have received no contact, no DC number, and the user is still active on the BTown forums. If anyone has any ideas, I will pursue them!

As an FYI, just because no money changed hands, you can still file for mail fraud.

You both agreed the items had a specific value. A trade of merchandise is the same as a trade of money. [after all charge cards, checks and even Paypal, are promisary notes. The only think that is equal to cash is; cash itself and money orders. Actually now, commercial money orders are more like checks.]

I was contacted this morning by jbarket. He told me that the product will ship out immediately. I'll update this BTR with the results.

jbarket made contact with me on 10/1. He had some real life issues (I edited his messages below for his privacy on that regard).
jbarket wrote:Sat Oct 01, 2011 11:29 pm

Hey Jeff,

Man I'm super sorry about all of this. [jbarket's real life issues removed for his privacy].

Anyway, none of that is yuor problem obviously. To make up for the excessive time, I threw in another squad of Doomies. Really sorry it took so long. I would understand if you left me bad feedback. Let me know if they've shown up.
StarmanTTLB wrote:Mon Oct 03, 2011 5:21 pm

I'm sorry to hear about the real life issues (glad to hear it's okay). I'm willing to forgive timing issues because of that kind of thing.

The package arrived.

It didn't have an extra unit of Reavers as you said, but oh well, they weren't part of the original deal.

Out of the 12 Reavers from the original deal, 4 are broken (all in places impossible or nearly impossible to fix), and 1 is missing a piece. No Reaver cards either. The Greylord Escort is as-promised, model and card. In your original post, you'd said that two of the Reaver models had come unassembled. Nowhere did you mention *broken* pieces, including after I'd specifically asked about their condition. I'd blame the packaging for the damage to the models, as you just put all 12 models into a single plastic bag together. That leaves 9 usable models out of a promised 13 usable models.
jbarket wrote:Mon Oct 03, 2011 6:08 pm

They're on the way separately, brand new. Sorry about the condition. I hope you can repair them. If the new squad isn't enough to make things right, let me know. Like I said, I know it wasn't OK for me to let my personal issues mess with our trade.
StarmanTTLB wrote:Tue Oct 04, 2011 5:55 pm

I appreciate the extra squad. If they're in okay condition, I'll end up with two full units of unbroken DRs from our trade, which should balance things out in that regard.

-Jeff
So basically, the package arrived. 5 out of 13 models in the package arrived irreparably broken, and the original deal stated that there were no broken models involved (see post #1, quoted messages #1 - #3), so it was most likely the poor packaging that did the breaking.

jbarket is sending a new box of Doom Reavers to me to make up for the condition of those that arrived and for the delay in shipping. While I'm still very unhappy with the trade, I'm willing to understand and forgive personal problems like he experienced.

Will update with the final results once the models arrive.

Oh, and I have a picture here of the 13 models jbarket sent to me, laid out and matched up with broken pieces:

Image

The left hand sheet of paper has the 7 unbroken doom reavers, matched up with their bases and separate pieces (unassembled, not broken).

The center sheet of paper has the 4 broken models and the 1 model missing a piece.

The right hand sheet of paper has the Greylord Escort model, NIB as promised.

Further update: No new squad has arrived (as jbarket promised to make up for the broken models), and he's also not communicating again.
StarmanTTLB wrote:Tue Oct 11, 2011 7:05 pm

I haven't received anything else, btw.

So I take it our trade is done?

-Jeff
His last communication was 10/3, and it's 10/15 as I post this. His profile says that he was online on 10/15 (but before I sent my latest message), so if I don't get a reply in a day or two, I'll consider it closed and will post a negative ref. He's getting a negative ref regardless, but I would include in the comment that he made up for the original bad trade with extra models were that to happen.

Since he got the models to me (although not in the promised condition or on time), I can't pursue mail fraud or anything of that nature to my knowledge. So it'll be a BTR and a negative ref only.

I believe mail fraud might still be an option. You didn't get what you were promised & it was sent via US Mail.

As for him being online on the 15th, does your PM from the 11th show as having been read?

If it's in the Outbox still, that means its unread, right? Then yes, that PM *has* been read. He also has read the PM sent on 10/15, and his profile shows activity on 10/17.

As for filing mail fraud, I assume I just fill out the form on the USPS site? I'll do that tonight.

I PM'd the OP yesterday with the following:
Invoice number is [redacted] from the War Store, being shipped directly to your house. Sorry it took so long. I don't expect you to take down the negative feedback. Hope you enjoy the Reavers when they're finally in hand.
So the new Reavers are actually on the way.

Regardless of my personal issues, I shouldn't have let a trade get like this. I don't expect any leniency here. At this point, I'm just hoping to come to a resolution where Starman doesn't feel like he got hosed on our trade, time required to get his half of it not withstanding.

Anyway, if there's anything else I can do, feel free to PM me.

Yep, received that message last night after I'd updated this thread.

I can understand the time delay with shipping, so I'm willing to let that aspect go. If/when the replacement doom reavers arrive, I'll have the correct total number of unbroken DRs, so that will close out our transaction.

The replacement DRs arrived yesterday. Overall, I now have the correct number of unbroken models as per the original agreement.

We can call this BTR closed now.
